Privacy Statement
Studiogilio BV cares about privacy and data protection. In the present Privacy statement, Studiogilio BV informs about how it processes personal data and for which goals, how long personal data is being kept and about your rights with regard to the processing of this personal data.
Please read this Privacy Statement carefully. By providing your personal data to Studiogilio, you declare explicitly to have read and accepted this Privacy Statement.
Article 1. Definitions
In this Privacy Statement, the provisions written with capital letter shall have the meaning accorded to them in this article 1 or further below in this Privacy Statement:
1.1 Agreement: the Assignment, as expressly accepted by Studiogilio, together with the General Terms and Conditions of Studiogilio.
1.2 Assignment: a description of the specific Services that Studiogilio provides to the Client.
1.3 Data subject: an individual who is not an employee of Studiogilio and whose personal data is processed by Studiogilio, such as customers, prospects and suppliers.
1.4 General Terms and Conditions: the general terms and conditions of Studiogilio BV, which can be obtained on request.
1.5 Personal data: the meaning according to Article 4, 1) of EU Regulation 2016/679 of 27 April 2016, namely: any information relating to an identified or identifiable natural person (a Data Subject); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
1.6 Privacy Statement: this Privacy Statement, including any document or annex referred to in this privacy statement.
1.7 Service Provider or Studiogilio: Studiogilio BV, with registered office located in Volmolenlaan 16, 3000 Leuven, registered in the legal entities register of Leuven under number 1007.382.216.
1.8 Services: (i) intellectual property services, in particular but not exclusively in relation to patents for invention such as applying for, prosecuting and acquiring patents for invention as patent attorney/mandatary of the Client; (ii) assisting the Client in related domains with activities arising from the capacity of patent attorney, such as assistance in disputes and in agreements relating to the exploitation of intellectual property rights, such as license agreements and as technical advisor in these domains; (iii) drafting documents with a view to obtaining, maintaining, exploiting, valorizing and/or defending intellectual property and other rights; and (iv) advising and assisting in other issues relating to intellectual property.
Article 2. Who does this Privacy Statement apply to?
This Privacy Statement applies to all Data Subjects.
Article 3. Which Personal Data does Studiogilio collect?
Studiogilio can collect following Personal Data: first name, family name, address, residence, e-mail, telephone number. This listing is not exhaustive.
Studiogilio relies on the correctness of the Personal Data entrusted to it by the Data Subject.
Article 4. Which Personal Data does Studiogilio process?
4.1. Based on the execution of an Assignment or Agreement
Studiogilio processes Personal Data required for the execution of an Assignment or Agreement in which you are an involved party. When Studiogilio files or prosecutes a patent application for you, Studiogilio processes Personal Data and professional identifiers to be able to correctly register the owner(s) of the patent application and the inventors in the official patent registers. Additionally, Studiogilio processes Personal Data in view of invoicing and payment.
4.2. Based on legitimate interest
Studiogilio processes Personal Data based on a legitimate interest, in which Studiogilio has made a balance of interests.
When you contact Studiogilio (via telephone, e-mail, website or social media), Studiogilio utilizes the Personal Data which you provide exclusively to answer your questions.
Studiogilio can process Personal Data when sending out newsletters or marketing messages and. Newsletters and marketing messages will only be sent if there is a client relationship. As a Data Subject, you can always indicate that you do not wish to receive these messages.
Studiogilio can utilize Personal Data to improve its internal processes and services.
Article 5. With whom does Studiogilio share your data?
Studiogilio does not share your Personal Data with third parties, except in the following circumstances:
5.1. Authorities charged with processing patent applications
For the execution of an Assignment or Agreement, it is required that Studiogilio provides certain Personal Data directly or indirectly (through third party service providers) to authorities charged with processing patent applications (e.g. Belgian Intellectual Property Office (IPObel) or the European Patent Office). This Personal Data will be made accessible via public patent registers and databases, in accordance with applicable (patent) legislation.
5.2. Engaging subcontractors
For a complete and high-quality service, Studiogilio engages certain subcontractors, such as service providers for executing searches in patent databases and foreign agents. For the execution of the Agreement, certain Personal Data must be provided to these subcontractors. Studiogilio shall ensure that these subcontractors take the necessary technical and organizational measures to process your Personal Data in a legal and lawful manner.
5.3. Other exceptions
Studiogilio can share Personal Data:
- with insurance companies, notary public, bailiffs in relation to the execution of an Agreement;
- when Studiogilio is required to do so in relation to a regulatory or judicial procedure;
- when Studiogilio is required to do so by legislative, judicial, administrative or supervisory authorities.
Studiogilio will never sell Personal Data. Studiogilio does not utilize fully automated decision making rules and does not perform profiling on the basis of Personal Data.
Article 6. Security of your Personal Data
Studiogilio cares about the security of your Personal Data and undertakes appropriate measures to prevent misuse, loss and unauthorized access. Studiogilio utilizes external service providers for digitally storing of collected Personal Data. These external service providers guarantee the security of the data with appropriate security technologies.
Article 7. How long does Studiogilio store your Personal Data?
Studiogilio stores the Personal Data entrusted to it no longer than needed for the purposes set out in this Privacy Statement, unless determined legal limitation or storage periods would require a longer term.
In the context of the execution of an Assignment or Agreement, Personal Data will be retained for up to 10 years after termination of the Assignment or Agreement in accordance with the General Terms and Conditions.
Article 8. Your rights with regard to the processing of Personal Data
Studiogilio shall process your Personal Data with respect for your privacy and in compliance with the applicable Belgian data protection regulations and EU Regulation 2016/679 of 27 April 2016 ("Global Data Protection Regulation", abbreviated as GDPR).
Each Data Subject has the right:
- to obtain access to its Personal Data, to request it and to receive information about how the Personal Data is processed;
- to correct and/or supplement its Personal Data if incorrect or incomplete;
- to have its Personal Data erased or to request a restriction of the processing of the Personal Data, unless the processing is necessary pursuant to a legal obligation or for the execution of the Assignment or Agreement;
- to withdraw consent for the processing of its Personal Data;
- to request its Personal Data with a view to portability.

Studiogilio tries to respond to your request as soon as possible, at the latest within 30 days.

Article 9. Amendments to this Privacy Statement
Studiogilio reserves the right to amend this Privacy Statement at all times. All amendments shall enter into force after the expiry of a period of one (1) month from the date of notification thereof by Studiogilio to the Data Subject.
